Welcome to AK American Builders (“Company,” “we,” “us,” or “our”). AK American Builders operates this store and website, including all related information, content, features, tools, products, and services (the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) govern your access to and use of our Services. By visiting, interacting with, or purchasing from our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you may not use our Services.

SECTION 1 – ELIGIBILITY AND ACCOUNT RESPONSIBILITY

You represent that you are at least the age of majority in your state of residence.

You agree to provide accurate, complete, and current information for all purchases and account registrations. You are responsible for safeguarding your account credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts at our discretion.

SECTION 2 – PRODUCTS AND CUSTOM WORK

We strive to accurately display our products. However:

  • Colors and finishes may vary by screen and lighting conditions.

  • Custom wood, epoxy, and fabrication materials naturally vary in grain, texture, and appearance.

  • Minor variations do not constitute defects.

All product descriptions, specifications, and availability are subject to change without notice.

We reserve the right to limit quantities or discontinue products at any time.

SECTION 3 – ORDERS, ACCEPTANCE, AND CANCELLATION

When you place an order, you are making an offer to purchase.

An order is not accepted until payment has been received and processed by AK American Builders.

24-Hour Cancellation Policy

Orders may only be canceled within twenty-four (24) hours of payment verification.

After 24 hours:

  • Materials are procured

  • Production scheduling begins

  • Labor allocation occurs

At that point, all sales become final in accordance with our Refund Policy.

We are unable to accommodate cancellation requests after the 24-hour period.

Your purchases are subject solely to our Refund Policy.

SECTION 4 – CUSTOM PRODUCTS AND DEPOSITS

All custom products require a 60% deposit prior to production.

By placing a custom order, you acknowledge and agree that:

  • Materials and labor are allocated specifically to your project.

  • Custom materials may be cut, modified, or specially ordered.

  • Production scheduling is reserved exclusively for your order.

Because these actions cannot be reversed:

  • The 60% deposit is non-refundable.

  • Custom orders are final after the 24-hour cancellation period.

Remaining balances must be paid according to the invoice terms before delivery or shipment.

SECTION 5 – PRICING AND BILLING

All prices are subject to change without notice.

Posted prices do not include:

  • Sales tax

  • Shipping

  • Handling

  • Customs fees (if applicable)

You represent that:

  • Your payment information is accurate

  • You are authorized to use the payment method provided

  • You agree to pay all charges incurred

We reserve the right to correct pricing errors and cancel orders if necessary.

SECTION 6 – SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by:

  • Carriers

  • Weather

  • Supply chain issues

  • Events beyond our control

Title and risk of loss transfer to you once the product is delivered to the carrier.

Any claims for damaged or defective products must be submitted in accordance with our Refund Policy within the stated timeframes.

SECTION 7 – INTELLECTUAL PROPERTY

All content on this site, including logos, designs, product images, text, CNC designs, renderings, and branding, are the property of AK American Builders and are protected under U.S. intellectual property law.

You may not reproduce, distribute, or use our content without written consent.

SECTION 8 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools. These are provided “as is” without warranties.

We are not responsible for third-party websites or services.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

AK American Builders is powered by Shopify. However, all purchases are made directly with AK American Builders.

Shopify is not responsible for:

  • Product performance

  • Refund decisions

  • Damages or losses arising from transactions

You release Shopify from all related claims.

SECTION 10 – PRIVACY

Your submission of personal information is governed by our Privacy Policy.

Because our store is hosted by Shopify, information may be processed by Shopify in accordance with its privacy policy.

SECTION 11 – FEEDBACK

Any feedback you submit grants us a perpetual, royalty-free, worldwide license to use such content for business purposes.

We are not obligated to compensate you for submitted feedback.

SECTION 12 – ERRORS AND OMISSIONS

We reserve the right to correct errors in pricing, descriptions, and availability at any time, including after an order has been submitted.

SECTION 13 – PROHIBITED USES

You may not use our Services for unlawful purposes, infringement, harassment, fraud, scraping, or any activity that harms AK American Builders or its customers.

We reserve the right to terminate accounts for violations.

SECTION 14 – DISCLAIMER OF WARRANTIES

Except as expressly stated, all products and Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.

To the fullest extent permitted by law, we disclaim warranties of merchantability and fitness for a particular purpose.

Some jurisdictions may limit disclaimers; in such cases, limitations apply to the fullest extent permitted by law.

SECTION 15 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, AK American Builders shall not be liable for:

  • Indirect or consequential damages

  • Lost profits

  • Business interruption

  • Replacement costs

Our total liability shall not exceed the amount paid by you for the product giving rise to the claim.

SECTION 16 – INDEMNIFICATION

You agree to indemnify and hold harmless AK American Builders, its owners, employees, contractors, affiliates, and Shopify from claims arising from:

  • Your violation of these Terms

  • Your misuse of the Services

  • Your breach of any law

SECTION 17 – GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.

You consent to the exclusive jurisdiction and venue of the state and federal courts located in Illinois.

SECTION 18 – SEVERABILITY

If any provision is deemed unenforceable, the remaining provisions remain in full effect.

SECTION 19 – ENTIRE AGREEMENT

These Terms, together with our Refund Policy and Privacy Policy, constitute the entire agreement between you and AK American Builders.

SECTION 20 – CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance of changes.
